DUI and OUI

BOSTON DRUNK DRIVING ATTORNEY
An arrest for operating under the influence of alcohol can change you and your families life. Collateral consequences, loss of license and potential jail time are factors that can severely impact you and your family. Attorney Brennan is an attorney you can trust to guide you through this difficult time

Collateral Consequences
Whether you resolve your case by negotiation or go to trial and are acquitted, your rights can still be severely affected by an OUI arrest. The collateral consequences and license penalties imposed by the Registry of Motor Vehicles in mangy cases can be as problematic as the actual crime charged. Know your rights before you engage in any field sobriety testing or deciding whether or not to take a breathalyzer test. Knowing your rights may be critical to your success in fighting your OUI case.

Driver’s license consequences are critical when charged with an OUI. We provide full service in both the criminal case and any Registry Hearings necessary to fight for your license. Attorney Brennan is seasoned in all aspects of DUI and OUI defense including 2nd, 3rd, 4th and all all other subsequent defenses.

Massachusetts OUI Laws
In Massachusetts there are two ways for a prosecutor to attempt to convict you. First, if your blood alcohol level is .08% or greater the the prosecutor can attempt to convict you on a “per se” law. Second, if there is no evidence of your flood alcohol level the prosecutor can attempt to convict you by convincing a jury that you consumed enough alcohol so that your ability to operate your motor vehicle safely was affected.

The Best Defense For Your OUI case
Preparation is your greatest tool in effectively defending your OUI case. Although you are presumed innocent, you should affirmatively investigate and develop your case to ensure the best defense to your case. Investigating the soundness of underlying convictions, utilizing the arresting officer’s field sobriety manual to show mistakes and determining whether helpful witnesses exist are just some of the efforts you will need to develop with your OUI attorney.
